ARTLAS COPYRIGHT POLICY

Artlas respects the intellectual property rights of artists, museums, content creators, and other rightsholders, and prohibits users from uploading content that violates those rights. This policy describes how images of artworks are used on the Artlas platform, the procedures for reporting copyright infringement, and how to submit counter-notices.

Image Use on the Artlas Platform

Images of artworks on the Artlas platform fall into one of two categories: (1) images of works that Artlas believes to be in the public domain, and (2) images of works that may be subject to copyright or other restrictions. For works that may be subject to copyright, Artlas displays only low-resolution thumbnail images, for educational, critical, research, and archival purposes. Thumbnails are displayed without zoom or download functionality and are accompanied by the work’s title, artist, and source institution, with a link to the source where available.

Higher-resolution images are displayed only for confirmed public-domain works or where the rightsholder or partner institution has provided explicit authorization. If you wish to re-use any image found on the Artlas platform, you must obtain permission from the copyright holder.

User Agreement and Content Ownership

By using Artlas, you agree to our Terms of Service, which require that all content you upload is accurate, lawful, and does not infringe on the rights of others. You retain ownership of your artwork uploaded to Artlas.

If you believe your copyrighted artwork appears on Artlas without your permission, you can submit a copyright infringement notice. To be valid, your notice must include:

  • Your Contact Information: Include your physical or electronic signature, email address, and phone number.
  • Identification of the Copyrighted Work: Clearly describe the artwork you believe is infringed.
  • Location of the Infringing Content: Provide a specific link or description of where the artwork appears on Artlas.
  • Good Faith Belief: State your belief that the artwork is used without your permission or legal authorization.
  • Accuracy Statement: Declare under penalty of perjury that the information in your notice is accurate and you are the copyright owner or authorized representative.

Submit your Notice

Send your notice to our designated Copyright Agent:

Our designated agent is registered with the U.S. Copyright Office’s DMCA Designated Agent Directory. Upon receiving a valid notice, we will act expeditiously to remove, or disable access to, the allegedly infringing material while we assess the issues raised in your notice, and we will promptly notify the user who originally uploaded the material.

Counter-Notice

If you believe your artwork was removed due to a mistaken copyright infringement claim, you can submit a counter-notice. Your counter-notice must include:

  • Your Contact Information: Include your physical or electronic signature and contact details.
  • Identification of Removed Content: Specify the artwork that was removed and where it appeared before removal.
  • Good Faith Belief: State, under penalty of perjury, your belief that the removal was a mistake or misidentification.
  • Consent to Jurisdiction: Agree to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Artlas may be found), and confirm that you will accept service of process from the person who submitted the original notice.

Submit your Counter-Notice

Upon receipt of a compliant counter-notice, we will restore access to the material within 10–14 business days, unless the original claimant informs us that they have filed a court action regarding the material.

Repeat Infringers

Consistent with our Terms of Service, Artlas will, in appropriate circumstances, terminate the accounts of users who are determined to be repeat infringers of copyright.

Our Commitment to Museums and Cultural Institutions

This policy is intended to ensure Artlas’s compliance with applicable copyright law. In the event that any third-party claim arises in relation to Artlas’s use of images of copyrighted works, Artlas agrees to indemnify and hold harmless museums and other nonprofit cultural institutions participating in the Artlas platform from and against any such claim, except to the extent the claim arises from materials the institution itself supplied.

For institutions that partner with Artlas:

  • We use partner-supplied materials solely to operate and display our services. We do not use partner content to train or fine-tune AI models; our systems retrieve and present institution-approved information.
  • Content is published only with the partner’s approval, and partners can preview their content before it goes live.
  • We display artist, copyright, and collection credit lines as the partner specifies.
  • Partners may request correction or removal of any content at any time. We action such requests promptly — normally within 48 hours, and within 24 hours for rights-sensitive matters.
  • Upon termination of a partnership, we delete partner-supplied data, including derived data such as search indexes and embeddings.

This framework was developed in consultation with U.S. legal counsel specializing in art and museum law.
